Section 385 update: Debt-equity regulations advance towards finalization

Debt-equity regulations advance forward

The Treasury Department today made an important step towards finalizing the section 385 debt-equity regulations. The regulations have been sent to the White House Office of Information and Regulatory Affairs (OIRA) for final review. This is typically the last step in the approval process before regulations are made final.

OIRA could now approve the regulations without changes, leading to finalization of the regulations as early as next week. Alternatively OIRA could suggest changes and return the regulations to Treasury for additional consideration. OIRA has 90 days from today to provide this review. Read about the review request on the OIRA website.
