Ireland – Launch of Employment Permits Online System...

This GMS Flash Alert reports on changes to the immigration system in Ireland that aim to help reduce processing times and ease the administrative burdens on employers and inbound employees and that enlarge the categories of employment positions that may be taken up under the Employment Permit rules.

New changes have been made to Irish Immigration law including the:

  • launch of the Employment Permits Online System;
  • commencement of the Online Appointment System for Immigration Registration (previously GNIB Registration); and
  • amendment of the list of highly-skilled eligible occupations and the list of ineligible categories of employment.

WHY THIS MATTERS

Global mobility advisers, immigration counsel, and globally mobile employees coming to Ireland need to be aware of the changes as the transition to online processes for both Employment Permits and Immigration Registration means a change of approach and an adjustment of procedures.  This move will help reduce processing times and ease the administrative burdens on employers and inbound employees. 

Moreover, the introduction of expanded lists for the highly-skilled eligible occupations list and the ineligible categories of employment list will enlarge the categories of employment positions that may be taken up under the Employment Permit rules.  This may enhance organizations’ ability to expand their businesses and develop their workforces to better meet their business objectives.  

Employment Permits Online System

The Department of Jobs, Enterprise and Innovation (“DJEI”) launched a new Employment Permits Online System (“EPOS”) on 5 September 2016.1  

The EPOS aims at streamlining the current employment permit application system, which should lead to faster processing times. This new online system will provide for the online submission of employment permit application forms and supporting documentation, as well as the payment of government filing fees through a secure payment system. 

KPMG NOTE

It is anticipated that there may be processing delays for employment permit applications during the transition period.  As such, we would advise that employers commence the immigration process for any new on-boarding non-EEA nationals as early as possible, where practicable.

Online Appointment System for Immigration Registration (GNIB Card)

The Irish Naturalisation and Immigration Bureau (“INIS”) has announced the introduction of a new online appointment booking system for Immigration Registration.2  This initiative is occurring as part of the transfer of the Registration Office administration from the Garda National Immigration Bureau (“GNIB”) to the INIS. 

This new system is due to launch on 8 September 2016, and will offer appointments for dates starting 15 September 2016.  The arrangement whereby non-EEA nationals queue for a ticket to apply for their GNIB Card will cease on 15 September 2016.  The new online system can be accessed from the INIS website at: https://burghquayregistrationoffice.inis.gov.ie/.

KPMG NOTE

This new system has been introduced to manage the high volume of non-EEA nationals applying for their GNIB Cards.  Non-EEA nationals who require a GNIB Card will no longer have to queue early in the morning in the hope of securing a ticket to apply for their GNIB Card.  The new appointments will be issued in hourly slots, thereby creating certainty for non-EEA nationals that they will be dealt with within a specific time period.  Note, there will be no change to the current registration process for non-EEA nationals residing outside of Dublin. 

New Employment Permit Regulations

Important amendments have been made to the current Irish immigration regime following the commencement of the Employment Permits (Amendment) (No. 2) Regulations 2016 and the Employment Permits (Trusted Partner) (Amendment) Regulations 2016 (the ”Regulations”).3 

Changes to the Highly-Skilled Eligible Occupations List (“HSEOL”) and Ineligible Categories of Employment List (“ICEL”)

The Minister has added a number of new occupations to the HSEOL, including paramedics and respiratory physiologists. 

The Minister has also added the following two accounting occupations to the HSEOL.  This is in addition to chartered accountants, certified accountants, and taxation experts specializing in tax, compliance, regulation, solvency, or financial management with the relevant skills and qualifications, which are currently listed on the HSEOL. 

i. Qualified accountants with at least three years' auditing experience, who are full members of either the American Institute of Certified Public Accountants (AICPA), the Philippine Institute of Certified Public Accountants (PICPA), or the Institute of Chartered Accountants of Pakistan (ICAP); whom have relevant work experience in the areas of U.S. GAAP reporting and Global Audit and Advisory Services; and the employment concerned is in MNC Global Audit Services.

ii. Tax consultants specializing in non-European Economic Area (EEA) tax consultancy and compliance with a professional tax qualification or legal qualification with tax specialization, and have a minimum of three years' experience of tax consultancy requirements and regulations in the relevant non-EEA market.

Further changes have been made to the ICEL.  In particular, legal associate professionals who are fluent in the official language of a state which is not a member state of the EEA and who have market knowledge of that non-EEA state have now been deemed eligible for an employment permit application.

Changes to the Intra-Company Transfer Permit

The Regulations have also amended the Intra-Company Transfer Permit application process in respect of Trainee applicants.  In particular, the minimum period of time that a Trainee is required to be in employment of a foreign employer has been reduced from six months to one month.
