Brazil: ICMS guidance

Guidance has been published concerning the ICMS—a state-level sales tax imposed on the physical movement of merchandise. The ICMS is also levied on certain inter-state and inter-municipal services.

The guidance relating to the ICMS—Imposto sobre Circulação de Mercadorias e Serviços—was released as Convênio ICMS nº 93/2015.

The ICMS guidance concerns the tax-sharing rules among the states, that is the state where the goods originated and the state of the destination of the taxable goods. The guidelines also apply with respect to services (for example, an interstate transport service). 

The guidance includes rules for when remittances of tax are to be made—in general, under the direction of the Guia Nacional de Recolhimento de Tributos Estaduais (GNRE) before the cargo is put in transit or before the beginning of the service. The guidance also includes rules for taxpayer registration, measures for claiming ICMS credits, and recordkeeping rules, among other items.
