FATCA: Updated instructions for Form 8938

The IRS today issued a release, reporting updates to the instructions for Form 8938, Statement of Foreign Financial Assets.

The IRS webpage on Form 8938 (updated March 10, 2015) reflects changes made to the Form 8938 reporting requirements, by final regulations under section 6038D (released in December 2014), and also contains additional information not included in the previously published instructions for Form 8938 (Rev. December 2014).

The updated IRS Form 8938 instructions include information concerning the reporting rules for dual resident taxpayers, accounts excluded from the definition of a “financial account” under a Model 1 or Model 2 intergovernmental agreement (IGA), and rules for joint filing of Form 5471 or Form 8865.
