Automatic exchange of country-by-country reports

Decree No. 8842/2016 (published in the official gazette 30 August 2016) includes measures concerning the automatic exchange of country-by-country (CbC) reports of multinational groups with business operations in Brazil and also for the exchange of administrative rulings issued by the tax authorities that grant special tax treatment to certain taxpayers.

Publication of the decree (Portuguese) allows for the exchange of CbC reports pursuant to Action 13 of the OECD’s base erosion and profit shifting (BEPS) project.

The OECD previously announced that Brazil’s instrument of ratification of the convention that allows for the automatic exchange of CbC reports under the BEPS project had been deposited with the OECD and will enter into force on 1 October 2016. Read TaxNewsFlash-BEPS
