April 13, the 5th International Tax Forum, organized by "Yuridicheskaya praktika" publishing house was held. Oksana Olekhova, who was a speaker during the session “Tax structuring, BEPS and TP”, presented KPMG in Ukraine.

During her speech on foreign jurisdictions for holding companies, Oksana Olekhova focused on practical aspects of business structuring. She also provided some recommendations that one should bear in mind when choosing the jurisdiction for a holding company. The expert also recommended paying attention to changes in taxation being accepted abroad, in particular, in the EU and the US.

"International legislation is undergoing changes in connection with BEPS initiatives, increasing transparency, tightening requirements to the disclosure and exchange with tax information.
Undoubtedly, the said processes will not bypass Ukraine as well - the possibility of adopting four steps of the BEPS is already being considered, the rules of transfer pricing are working well enough, the tax authorities are actively exchanging with information. Requirements to business are changing. The traditional approaches to structuring do not work or stopped working. In this regard, both government agencies and taxpayers need to be prepared - the former should strive to apply international approaches in the tax risks analysis, while the businesses should ensure that their structures and documents are consistent with the economic substance of the business. Therefore, it is important that the events like the Tax Forum help all parties to keep abreast of the latest developments and trends, and to assess the possible consequences of those changes", - Oksana Olekhova summed up the results of the event.
