On 28 and 29 November 2017, Volodymyr Chyzhykov, Senior Manager and Evgen Dmytrenko, Manager, TP Group, KPMG in Ukraine conducted a TP seminar “Income tax return: the three questions every accountant should be able to answer immediately" for specialists from various business sectors.

The seminar was attended by Mykola Mishin, Head of Transfer Pricing Audits Unit with SFS of Ukraine Tax & Customs Audit Department, as a pre-announced “secret guest”.

The issues highlighted at the seminar included tax liabilities adjustment prior to submittal of the return, tax return completion and potential risks, documents and calculations to support full deduction of imports from low-tax jurisdictions, and actions to respond enquiries from the SFS.

“Documentation for income tax purposes (regarding 30% limit on imports) should be prepared on an annual rather than quarterly basis,” noted Evgen Dmytrenko.

The experts also presented a TP application and conducted a training on how to determine the necessity for TP adjustments, together with example adjustment computations for different types of transactions.

“Here are some tips to understand if you have any internal risks. For royalties, rates up to three per cent are ‘normally secure’; for loans, interest rates up to six per cent are justified; for intra-group services, profitability of up to five per cent would be within the market range,” noted Volodymyr Chyzhykov.
