In the recent time the Polish government has undertaken a number of initiatives aimed at incorporating into the Polish legal system solutions and concepts proposed by the OECD, which directly concern CIT taxpayers. As part of these initiatives the concept of the Standard Audit File (SAF) has been implemented, which imposes an obligation to transmit the detailed data in a unified SAF format on certain taxpayers. Moreover, actions aimed at implementing the General Anti-Avoidance Rules (GAAR) into the Polish tax law have also been taken recently.

Following the already adopted as well as upcoming amendments concerning CIT taxpayers, determining the correct amount of the tax base, transparency of the transactions as well as the fulfillment of the obligations imposed on taxpayers by the statutory regulations are becoming more easily verifiable by the Polish tax authorities, and the risk of identifying any irregularities for the Polish taxpayers is as high as never before.
