Public Procurement Act

The Public Procurement Act was promulgated in December 2015, however the Regulations were only recently published in March 2017. The Act covers all State-Owned Enterprises and per section 3 is applicable to:

  • all procurement of goods, works and services and disposal of assets undertaken by the Board or a public entity;
  • the letting and hiring of anything or the acquisition or granting of any right; and
  • contract management of goods, works and services procured or disposed of by the Board or a public entity.

As part of its Regulatory Compliance services, KPMG is able to assist with:

  • Drafting or revising the existing procurement policy, taking into account the requirements of the Public Procurement Act and applicable Regulations and also based on our experience working within the Public Sector; and/or
  • Conducting workshops for the entity’s relevant personnel, covering the essentials of the Act and the requirements that need to be met when procuring goods and services; and/or
  • Benchmarking policies and procedures with other entity’s and based on our experience in the relevant sector.
