The new mandatory disclosure rules applicable to tax intermediaries and taxpayers

KPMG Luxembourg is holding a conference on the new rules requiring intermediaries (and taxpayers) to disclose information.

Mandatory disclosure rules are one of the latest EU initiatives designed to increase tax transparency and improve exchanges of information in tax matters. On 25 May 2018, the Economic and Financial Affairs Council (ECOFIN) adopted the amendments to the Directive on administrative cooperation in the field of taxation (commonly referred to as DAC 6) as regards the mandatory automatic exchange of information in relation to reportable cross-border arrangements.

The rules, which will introduce a new reporting obligation for EU intermediaries (or taxpayers), entered into force on 25 June 2018.

Many financial institutions (e.g. banks and insurers), asset managers, and other taxpayers involved in cross-border activities are likely to fall within the scope of the new rules and must therefore start monitoring their transactions and seeking answers to questions such as which transactions will have to be reported and by whom.
