After 75 years, Kenya passed a new and modern mining code which was assented to on 6th May 2016. The new Act reflects the spirit and intent of the Constitution of Kenya 2010 to ensure that activities related to mining and exploitation of minerals are beneficial to the citizens of Kenya.
The Mining Act 2016 establishes an institutional framework that is aligned to international best practise where the policy, regulatory, and commercial functions of government are separated to enhance good governance in the mining sector. Along with providing guidelines for licensing and other related mining sector activity, the new law clarifies the role of county governments in provision of consent for licensing operations as well as promoting community engagement in mining operations.
